It has been mentioned in each bill that only hemp-derived delta 8 products are allowed to be used in Louisiana. The use of marijuana-derived delta products is yet not legalized in Louisiana.

Let's look at the legality journey of delta 8 products in this country to understand “is delta 8 legal in Louisiana?”

2018 Farm Bill:

This delta 8 bills were approved in December 2018. According to this bill, the consumption of industrial hemp and all its parts was legalized across the entire United States.

The legal compounds of hemp mentioned in that bill were leaves, stalks, flowers, stems, Cannabinoids (Delta 8 THC), extracts, derivatives, isomers, salts, etc. The legally approved concentration of delta 9 THC content in industrial hemp products was 0.3%.

2019 Legality Status Of Delta 8:

In 2019, Louisiana passed HB 491 to line up state laws with federal laws. This law legalized industrial hemp with a THC content of no more than 0.3% on a dry weight basis. Similar parts of industrial hemp were legalized in this law, as were mentioned in the 2018 farm bill.

Louisiana Delta-8 THC Laws 2021:

Louisiana passed HB640, another delta 8 law, in 2021. The critical clause of this law states that:

"Consumable hemp product” means any product derived from industrial hemp that contains any cannabinoid, including cannabidiol, and is intended for consumption or topical use." Louisiana HB640

This bill legalized the use of delta-8 products with the following limitations:

·         It was not allowed to sell Hemp products for inhalation purposes.

·         The hemp products must contain less than 1% total THC.

·         All vendors needed to register their Hemp products with the state.

2022 Louisiana Bill For Hemp Products:

Louisiana passed a new bill (HB 758) in 2022 that sternly limits the THC content of consumable hemp products. In this bill, the legal concentration of THC for adult-use consumable hemp products was 0.5 milligrams of total THC per package.

This law states that:

“For consumable hemp products, a product shall not exceed a total delta-9 THC concentration of more than 0.3 percent or a total THC concentration of more than one percent. The total THC in a product shall not exceed eight milligrams per serving. The provisions of this Subparagraph shall not apply to floral hemp material.” Louisiana HB 758

Conclusion:

Hence, the above laws prove that hemp-derived Delta 8 THC is federally legal in the United States and in Louisiana.

All legalized Hemp products must contain an acceptable level of Delta 9-THC, less than 0.3 %. To protect you from lawsuits, you should not consume delta 8 products with more than the allowed levels of THC.
